1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of BreakMade's website and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Services.

2. Use License & Restrictions

Subject to these Terms, BreakMade grants you a limited, non-exclusive, non-transferable, revocable license to use our Breakdance framework and design resources for your website development projects.

2.1 Restrictions

You agree not to:

• Share your account credentials with unauthorized users
• Redistribute or resell BreakMade resources without permission
• Use the Services for any illegal purposes
• Interfere with the proper functioning of our Services
• Attempt to gain unauthorized access to our Services
• Scrape or collect data from our Services without permission
• Remove copyright notices from our design resources

3. Account Terms

To use our Services, you must:

• Create a valid account with accurate information
• Keep your account credentials secure
• Update your information as needed to maintain accuracy
• Report any unauthorized access immediately
• Be responsible for all activity under your account

4. Payment Terms

4.1 Subscription Plans

We offer lifetime access to our Breakdance framework and design resources. Payment is required in advance. By purchasing, you authorize us to charge your payment method for the selected plan.

4.2 Refunds

BreakMade purchases are final and non-refundable after the initial 14-day period. If you're not satisfied with our Services within the first 14 days after purchase, please contact our support team. We appreciate your understanding of this policy.

4.3 Price Changes

We reserve the right to modify our pricing. Existing customers will not be affected by price changes as our plans provide lifetime access to the purchased resources.

5. Framework and Resources

BreakMade provides a framework and design resources for Breakdance website builders. While we strive for excellence, we do not guarantee that our resources will meet all your specific requirements. Users are responsible for customizing resources to fit their specific needs.

We implement reasonable security measures but cannot guarantee absolute security of your data or account.

6. Intellectual Property

The Services, including all content, features, design resources, and functionality, are owned by BreakMade and are protected by international intellectual property laws. You may use our resources for your projects but may not claim ownership of the original resources.

7. User Content

You retain ownership of your websites and projects created using our framework. By using our Services, you grant us permission to showcase your projects (with attribution) for promotional purposes unless you explicitly opt out.

8. Limitation of Liability

BreakMade is not liable for:

• Compatibility issues with third-party plugins or themes
• Changes in Breakdance functionality that may affect our resources
• Service interruptions or data loss
• Decisions made based on our design recommendations

9. Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted access to our Services. We reserve the right to modify or temporarily suspend Services for maintenance or updates.

10. Affiliate Program

BreakMade offers an affiliate program that allows eligible customers to earn commissions by referring new customers. By sharing your referral link, you automatically agree to the following terms.

10.1 Eligibility

The affiliate program is available to customers with an active paid plan. BreakMade reserves the right to change eligibility requirements at any time. We may approve or reject affiliate participation at our sole discretion.

10.2 Commissions

Affiliates earn a percentage-based commission on qualifying sales made through their unique referral link. Commissions apply to both initial purchases and subscription renewals. Commission rates are set by BreakMade and may be changed at any time with notice. Commissions on refunded or disputed transactions will be reversed.

10.3 Referral Rules

A valid referral occurs when a new customer clicks your unique referral link and completes a purchase. The referral must be the customer's first purchase through BreakMade. Cookie tracking is used to attribute referrals; the attribution window is determined by BreakMade.

10.4 Prohibited Practices

Affiliates agree not to:

• Self-refer or use their own affiliate link for personal purchases
• Use spam, unsolicited emails, or misleading advertising to promote referral links
• Bid on BreakMade branded keywords in paid search ads
• Create coupon or deal websites primarily for affiliate commissions
• Misrepresent BreakMade, its products, or the affiliate relationship
• Use cookie stuffing, click fraud, or other deceptive tracking methods
• Register domain names that include BreakMade trademarks

10.5 Payouts

Commission payouts are processed according to the schedule and method determined by BreakMade. We reserve the right to withhold payouts if we suspect fraudulent activity or policy violations, pending investigation.

10.6 Termination of Affiliate Status

BreakMade may suspend or terminate your affiliate status at any time for violations of these terms or for any other reason at our sole discretion. Upon termination, pending commissions may be forfeited if the termination is due to a policy violation. Termination of affiliate status does not affect your product license or account access.

11. Termination

We may suspend or terminate accounts that violate these Terms. Upon termination, you will lose access to our Services and resources. You may continue to use resources already downloaded for existing projects, but may not use them for new projects.
